Can an S corp be a partner in a partnership?

Any corporation can be a partner in a general partnership, including an S corporation. While a general partnership is not a legal entity, it is a formal business relationship between at least two people. In most legal situations, a corporation is treated as a person.

Is a Tax ID (EIN) required for a Partnership? Yes, Partnerships are required to obtain a Tax ID: Before filing Form 1065 a Partnership must have a Tax ID (EIN). A Partnership’s Tax ID number is called an “employer identification number,” or EIN, and comes in the format 12-3456789.

How do I get an EIN number for a partnership?

According to the IRS, you can use their website to apply for a tax ID number online, and you can also apply by fax – using the SS-4 – or just by calling the IRS, providing your business information over the phone and getting a new EIN on the spot.

Does an S Corp have an EIN?

As a result of the Subchapter S restrictions, a LLC cannot be a shareholder of an S corporation. This makes sense for tax-collecting purposes because the S corporation would pass its income through to the LLC shareholder, which could also be taxed as a disregarded entity that could pass the income through to an owner.
